Terms of Service

Welcome to FitPros.io. These Terms of Service ("Terms") govern your access to and use of the FitPros.io platform, including the website at fitpros.io, the coach dashboard, and client-facing mobile applications (collectively, the "Service"), operated by FitPros.io ("we", "us", or "our").

By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 16 years old to use the Service. By using the Service, you represent that you meet this requirement and have the legal capacity to enter into these Terms.

2. Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use. We reserve the right to suspend or terminate accounts that violate these Terms.

3. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable laws
• Upload content that is harmful, abusive, defamatory, or infringes on intellectual property rights
• Attempt to gain unauthorized access to the Service or its systems
• Interfere with or disrupt the Service or servers connected to it
• Scrape, crawl, or use automated means to access the Service without our permission
• Impersonate another person or entity
• Use the Service to send unsolicited communications (spam)

4. Coach Responsibilities

If you are a coach using the Service, you are responsible for:

• Ensuring you have appropriate qualifications and certifications for the training services you provide
• Obtaining necessary consent from your clients before entering their personal data into the platform
• The accuracy and legality of the content you create, including workout programs and client communications
• Complying with all applicable laws related to personal training and health/fitness services in your jurisdiction

FitPros.io is a software tool. We do not provide personal training, medical advice, or fitness instruction. Coaches are solely responsible for the services they deliver to their clients.

5. Client Data

Coaches control the client data they enter into the platform. FitPros.io processes this data on behalf of coaches. Coaches are responsible for ensuring their use of client data complies with applicable privacy laws. See our Privacy Policy for more details on how we handle data.

6. Subscriptions and Payments

The core Service is available for free. Optional paid features ("Pro Tools") are available through a monthly or annual subscription. By subscribing:

• You authorize us to charge your payment method on a recurring basis
• Subscriptions auto-renew unless canceled before the next billing cycle
• You can cancel at any time. You'll keep access through the end of your current billing period
• Refunds are handled on a case-by-case basis; contact us at sam@fitpros.io

We reserve the right to change pricing with 30 days' notice. Price changes will not affect your current billing period.

7. Program Sales

Coaches may sell workout programs through the Service. When a coach sells a program:

• The coach sets the price and is responsible for the program content
• FitPros.io facilitates the transaction through Stripe
• The coach is responsible for applicable taxes on their program sales
• Buyers may request refunds directly from the coach

8. Intellectual Property

The Service, including its design, code, logos, and branding, is owned by FitPros.io and protected by intellectual property laws. You may not copy, modify, or distribute any part of the Service without our written permission.

You retain ownership of the content you create on the platform (workout programs, notes, etc.). By using the Service, you grant us a limited license to host, display, and transmit your content solely for the purpose of providing the Service.

9. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the Service will be uninterrupted, error-free, or secure.

10. Limitation of Liability

To the maximum extent permitted by law, FitPros.io and its founder, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising out of or related to your use of the Service.

Our total liability for any claim arising from or related to the Service shall not exceed the amount you paid us in the 12 months preceding the claim, or $100, whichever is greater.

11. Indemnification

You agree to indemnify and hold harmless FitPros.io from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.

12. Termination

We may suspend or terminate your access to the Service at any time for violation of these Terms or for any other reason at our discretion. Upon termination, your right to use the Service ceases immediately. You may request a copy of your data within 30 days of termination.

13. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. Continued use of the Service after changes are posted constitutes acceptance of the revised Terms.

14. Governing Law

These Terms are governed by and construed in accordance with the laws of the United States. Any disputes arising from these Terms or the Service shall be resolved through good-faith negotiation, and if necessary, binding arbitration.
